There are many ways in which an accident can occur at a construction site in California. One of the most dangerous types of accidents is when a large structure unexpectedly collapses. Therefore, employers should make sure that all structures are secured and all safety precautions are followed. However, despite making the best efforts, this type of incident can still occur and can result in an injured worker claim and the need for employer defense.
This is what recently occurred at a construction site in California one afternoon in late August. At approximately 1 p.m., a 21-foot scaffolding buckled and collapsed. The scaffolding had a platform for each floor of the building that the workers were working on. Apparently, the work crews had been installing windows and siding for each of the floors of the tower.
The construction crews had been working on the tower project since November 2014. The tower that the construction crew was working on reportedly has six floors. Healthcare group McCarthy NM had been overseeing the construction project, which totaled 300,000 square feet. Seven people were injured and one person died in the accident.
Now the healthcare group will be facing an investigation by the Occupational Health and Safety Administration (OSHA). Employer defense may be required if OSHA decides to issue citations for alleged violations. Also, the employer could face an injured worker claim as well. Therefore, it is best that the company understands all of the legal rights available to an employer in these types of situations in California.
