Employer Defense May Be Required After Fatal Industrial Accident

Most employers care about the well-being of their workers. This is why employers usually take special care to ensure the safety of workplaces in California. However, there are some types of workplaces that inherently have more hazards than others. An industrial workplace is one of these types of work environments, meaning the hazards present also increase the chances of the need for employer defense.

The accident happened at an industrial site in early August and resulted in one fatality. Around 1:20 p.m., a worker at the industrial site somehow ended up being pinned underneath a container. How this happened has yet to be determined. Authorities are now continuing their investigation into the incident in order to determine what could have possibly caused the tragedy.

Authorities pronounced the worker dead at the scene of the incident. The man was 55 years old at the time, according to reports released by authorities to the public. The sheriff’s department is now working with the Occupational Safety and Health Administration in its investigation of the fatal accident. There have yet to be any reports of work safety violations being suspected by OSHA.

On the other hand, the investigation has yet to be concluded, which means it is still possible for OSHA to issue citations for alleged safety violations. If this is the case, the employer may still have some options available. Just like any employer who is cited for violations in California, this employer will still be able to utilize an employer defense strategy to appeal the citation.
